The City Council went thru a process of developing a Permanent Commercial Cannabis Ordinance. On November 1, 2017, the City Council extended the moratorium it had previously enacted in late 2016 to all commercial cannabis land uses. The ordinance was extended for nine months. During this final extension period for the moratorium, staff promptly began the process for enacting a permanent, regulatory ordinance. The City held (2) public workshops, produced a survey, hired a cannabis consultant and provided updates every other month at council meetings.
On Tuesday, May 22, the City Council introduced an ordinance establishing a new Cannabis Business (CB) Zoning Overlay District and accompanying text amending Title 9, Chapter 5 of the Antioch Municipal Code, thereby creating new provisions for the consideration of cannabis businesses in the City of Antioch. This ordinance provides areas in the City of Antioch where individuals may apply for a City Council Use Permit to establish a Cannabis Business. Each new Cannabis Business must be located at least 600’ from a school, City park, or residential district and must meet specific findings for approval. The ordinance is expected to take effect around July 31, 2018. The CB Zoning Overlay District generally includes the industrial/commercial areas between the San Joaquin River and East 18th Street and the Verne Roberts Circle area. The map of the approved CB Zoning Overlay District is shown below. The City Council’s second and final reading of the Ordinance occurred on June 26, 2018. In addition, staff intends to bring Cannabis Guidelines to the City Council for review and approval in August 2018. These guidelines will express the City’s expectations for future applicants about the operation of cannabis businesses and will offer staff, the Planning Commission, and City Council a basis for reviewing applications. NEW PUBLIC HEARING Cannabis Ordinance – The Community Development Department has recommended amendments to Chapter 5 of Title 9 of the Antioch Municipal Code (Zoning Ordinance) to create a Cannabis Business (CB) Overlay District within the City of Antioch. The amendments would establish an overlay zoning district wherein an applicant could apply for a Use Permit from the City Council to operate a cannabis business. The amendment will also include applicable definitions, setback requirements, and procedures.
